You MUST create new original designs that are significantly different than original graphics purchased and use within a wider design.

Do this by combining other elements, backgrounds, text, textures and other designs into your new creation.

For digital designs make sure the original artwork CANNOT be extracted by a third party.

Should you wish to use the graphic/s stand alone, I offer an Enhanced Art License for most of my products. Should your client need access to the source files, they would need to purchase their own licence.

You MUST use patterns in a new wider original design, never as a stand alone item. Do this by combining other elements, backgrounds, text, textures and other designs into your new creations.

For digital products

You may create digital printables for sale, providing that they are an original design with a set purpose. For example a flattened calendar design, a wedding stationary suite, you sell to a client or company branding items, like logos, websites and social media posts and banners that uses the resources within a  wider original design would be considered as within our terms of use. Because of this reason digital stickers and digital wall art aren’t allowed. 

 

Print-on-Demand (P.O.D) Websites

Flattened design can be sold as a variety of different physical end products. i.e. you can create a wider original design that you/they upload to the P.O.D as a digital clipart file, however your customers can only purchase the end design as a physical item as T-shirt, mug, wall art etc. via the POD website. They don’t get access to the digital file themselves.

 

Designs must be uploaded flat. A layered PSD, vector file or transparent PNG file is NOT permitted. This means that the Resources may not be uploaded separately allowing the end users to edit and move the graphics.

 

Fonts may NOT be embedded or uploaded to any P.O.D website, as this would allow for third parties to work with them who have not purchased a licence for the fonts.

 

*An Original Design is achieved by using the graphics or patterns (also known as the Resources) as part of a wider design and not stand-alone. By adding text, backgrounds, other design elements, and overlapping elements, etc., you can create a unique, original design and ensures that Resources cannot be extracted.

This license allows you to upgrade any License for a product up to an Enhanced License.  One License per product.

The Enhanced Licence will only apply to and cover Illustrations and Patterns.  All of the same obligations apply for the Enhanced Licence and the standard Commercial Licence, with the following additions:

  • You may use the Illustrations and Patterns you purchased with the Enhanced Licence to create physical End Products for sale.
  • The Physical End Product may be sold an unlimited number of times.
  • You may use the Illustrations and Patterns purchased under the Enhanced Licence in a stand-alone manner to create physical End Products for Sale. You may form the main integrity of the physical End Product using the Licensed Resources and they do not need to be used as part or within a wider design.
  • NOT PERMITTED: resale or sublicense of the Licensed Resource in source file form or otherwise competitive with the original Licensed Resource.
  • NOT PERMITTED: Creating digital End Products under the Enhanced Licence.
  • NOT PERMITTED: Claim ownership or copyright.

Yes absolutely! The Standard Licence which is the basic licence included in the price of the listing covers both personal and commercial use. You may use the Resources in multiple commercial projects. Should you wish to use the Resources on End Products for sale, you may sell up to 5 000 units collectively.

This artwork is property of Lusi Art and is for personal use only. You may print these files as many times as you’d like, but commercial use is strictly prohibited. Please refrain from sharing, re-selling, or uploading to publicly available websites. By purchasing this listing, you agree to uphold the copyright agreement. Modification, resale, or public distribution of any kind for commercial purposes, is strictly forbidden.

All my Procreate brushes come with the Add-on license – this is slightly different to the Graphics License

With the Add-ons license you can use the brushes in unlimited projects even if you plan on selling those projects. Any work you create using the brushes belongs to you and you are welcome to sell the artwork or use your creations in any way you like – once you create the illustration, you own it 100%. There are no restrictions as to how many projects you create and how many items you sell that were created with the brushes. Think of them as art supplies you purchase from an art store, these are just in digital form!

 

However, please take note of the following restrictions
  • Sharing the original brushes and shapes is not permitted. 
  • Pattern brushes and stamps may not be used as is, but can be used within a design as part of a wider creation.
  • Copying brushes and tweaking slightly to resell as your own is strictly prohibited.

You can use the font:

  • In multiple commercial projects
  • To create stand alone phrase/quote art to sell on items like mugs, t-shirts, tote bags, stickers, etc.
  • Stand alone for logos as long as they are for personal projects or an individual client (should the client need access to the font, they would need to obtain their own license)
  • In e-books, online publications, and websites for personal use or one-time client projects provided the font is not uploaded onto a third party system for third parties to access or extract
  • To create Word art as long as they are being used as part of a wider design and not as a stand alone singular word

The Add-Ons Licence pertains to the Procreate Resources (Brushes, Canvases etc) and Fonts. Whereas the Standard and Extended Licences pertain to the Graphics, Illustrations, Creators and Textures available for sale on www.lisaglanz.com.

Add-Ons Licence for Brushes and Fonts

The Add-Ons Licence pertains to the Procreate Resources and Fonts. With the Add-ons license you can use the brushes in unlimited projects even if you plan on selling those projects. Any work you create using the brushes belongs to you and you are welcome to sell the artwork or use your creations in any way you like. 

 

There are no restrictions as to how many projects you create and how many items you sell that were created with the brushes. Think of them as art supplies you purchase from an art store, these are just in digital form!

 

However, please take note of the following restrictions:

There is no difference in the product files you’ll receive, both licences include the full version of the product you purchase under either licence.

The difference however lies within the terms of the licence and what is permissible under these terms. In the case of the Standard Licence and Extended Licence, the only difference is the quantity of End Products sold. 

 

Under the Standard Licence you may sell 5000 units of your End Products, and under the Extended Licence you may sell up to 250 000 units of your End Product you create using the graphic resources. All other usage terms are the same for both licenses.

The current licence requirements for the Standard Licence and Extended Licence requires you to use any Resources (graphics or patterns) as part of a wider, original design – they cannot be used alone.

You need to combine your purchased product with other resources and artwork to form an original design, so that it doesn’t constitute the primary integrity of the design. Your end design needs to be noticeably different from the original resource purchased. 

If you are selling a digital end product you need to ensure that the original Resources cannot be extracted in addition to the above-mentioned requirements. You can achieve this by overlapping items, adding text, backgrounds, other design elements, etc.

 

Yes. Your project must produce new and unique artwork. All product resources must be used as part of a broader design and cannot be used stand-alone. By adding text, additional and/or overlapping graphics or elements, backgrounds, unique designs can be created.

As with all licences, there are terms and conditions to protect both you and the creator. I know licensing can get really confusing which is why here are some more details that need to be mentioned:

 

  • End Products must be significantly different than the original Resource purchased. You must combine the Resources with other creative elements to ensure licensed Resources are used within a wider design to form an Original Design. An Original Design would be something you put time, effort and skill to produce, ensuring the Resources are not the primary integrity of the Design or End Product. The Resources should be used to facilitate your creative expression resulting in unique work different from the original Resource purchased. The Resources may not be used stand alone (I offer an Enhanced Art Licence for most of my products should you wish to use the Resources stand alone).
  • End Products may not be used or sold in a way that is directly competitive with the original Resource you purchased.
  • Patterns purchased under the Standard Licence and Extended Licence may not be used stand alone. They may be used as backgrounds that form part of a wider design; as an overlay; or to fill a specific area within your Original Design. I offer an Enhanced Art Licence for my royalty-free Patterns should you wish to use them stand alone.

  • End Products may not be sold or supplied in a way that allows for third parties to easily extract the Resources.

  • If you are creating and selling digital end products you would need to ensure that the original resources may not be extracted. Files sold may not be layered or editable and must be supplied flat without access to the original source files used. By adding text, backgrounds, other design elements, and overlapping elements, etc., you can create a unique, original design and ensures that Resources cannot be extracted.

Yes definitely! Bare in mind you will need to upload and sell a flattened, Original Design* where the Resources cannot be extracted or edited/customised by a third party. 

In other words: you may sell pre-designed End Products “on demand” (i.e. as your customers order them) using a printer/production partner, as long as your customer doesn’t have control over the design in any way that allows them to move/rotate design elements, or personally customize the design. However, uploading original, flattened artwork (such as backgrounds, invitations, cards etc.) and allowing third parties to add custom text using the P.O.D website’s standard font options is allowed. 

For example, your customer may order a tee shirt you’ve designed as a pre-made End Product; next, your print-on-demand provider produces and delivers that End Product to your customer. This is permitted under the license terms.

It’s important to note that you may not supply source files to your customers or supply it in a format that allows for easy extraction. If your customers require the source files they would need to purchase their own licence for the graphics used.

 

The files need to be supplied flat – .psd, .ai, and vector-based pdf files are NOT permitted. If you would like to supply a .png file, you would need to ensure the design of the logo doesn’t allow for easy extraction of the original Resource.

You are allowed to provide your printer with source files for the sole purpose of printing your work, provided that once the printing has occurred, the supplied files are deleted from their system. 

 

You are not permitted to provide a layered file to clients. Instead they should be provided with the final, flattened designs. If your client requires access to source files to make additional changes to the design, including the a vector file for a logo, for example, they will require a license of the graphic/font for themselves.

 

Yes you may, please bare in mind though that licence terms and conditions apply. A new Original Design* (see related articles for more info) needs to be created on all your items including stickers, and files are supplied in a manner that doesn’t allow for easy extraction.

 

For example, it is not permitted to use a resource on it’s own on a white background, the resource can easily be extracted and a new Original Design hasn’t been created. You may not include any source files or layered files, including, but not limited to PNG, PSD, AI, SVG or vector based PDF files. The graphics may not form the main integrity of the design or kit.

When you purchase a graphic/illustration/pattern from Lisa Glanz, you are agreeing to a non-exclusive and non transferable licence which does not allow for copyrighting or trademarking.

 

Using the Procreate brushes

Yes absolutely. Any original artwork you create using Procreate brushes purchased from www.lusiart.com belongs to you. Which means you, the original creator of that artwork, are the copyright owner. The Procreate brushes are like any other art supply you would purchase at an art store to create your own art with. These are just in digital form.

 

The freebies come with a Standard Licence for a single user, which allows for commercial use unless otherwise stated under “Licence Included”.

No, unfortunately you are not permitted to create cut files, embroidery files and appliqué templates from the Resources – this would be a form of redistributing the original artwork and end products of this nature are in contravention of the licence agreement.
